(A consumer is any natural person who enters into a legal transaction which, for the most part, cannot be attributed to their commercial or self-employed professional activity.)
Information About Withdrawal
Right of Withdrawal
You have the right to withdraw from this agreement within 30 days without giving any reason.
The withdrawal period is 30 days from the date:
- on which you, or a third party designated by you who is not the carrier, took possession of the goods, insofar as you ordered one or more goods under one order and these were delivered at the same time;
- on which you, or a third party designated by you who is not the carrier, took possession of the last goods, insofar as you ordered several goods under one order and these were delivered separately.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this agreement. This can be done by email: info@zyvaro-london.com.
You may use the attached model withdrawal form for this purpose, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send the notification concerning the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this agreement, we will refund all payments received from you, including delivery costs, with the exception of additional costs resulting from your choice of a delivery method other than the standard delivery offered by us, immediately and no later than within 30 days after receiving your withdrawal notice.
For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise. In no case will this refund result in additional costs for you.
We may refuse the refund until:
- we have received the returned goods, or
- you have provided proof that you have returned the goods, whichever occurs earlier.
You must return or hand over the goods to us immediately and no later than within 30 days from the date on which you informed us of the withdrawal from the contract. The deadline is met if you send back the goods before the 30-day period has expired.
The direct costs of returning the goods are your responsibility.
You are only liable for any diminished value of the goods if this loss in value is due to handling the goods in a way that goes beyond what is necessary to establish their nature, characteristics and functioning.
Reasons for Exclusion and Expiry of the Right of Withdrawal
The right of withdrawal does not apply to agreements:
- for the delivery of goods that are not prefabricated and that have been manufactured based on an individual choice or decision by the consumer;
- for the delivery of goods that can spoil quickly or have a limited shelf life;
- for the delivery of alcoholic beverages whose price was agreed upon in the agreement, but which can only be delivered no earlier than 30 days after the conclusion of the agreement and whose value depends on market fluctuations;
- for the delivery of newspapers, journals or magazines, with the exception of subscriptions.
The right of withdrawal expires prematurely for agreements:
- for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene, if the seal has been broken after delivery;
- for the delivery of goods which, after delivery, have been inseparably mixed with other goods due to their nature;
- for the delivery of audio and video recordings and computer software in sealed packaging, if the seal has been broken after delivery.
